- BFTV respects your
privacy and your choices. Because access and use of this site involves
the transfer of certain information about you, this Privacy Policy is
designed to inform you of what information is collected by us, how we
use it and store it, and the choices you have regarding that policy.

using it in any way.

applies to all users of the Site, whether you are simply browsing this
Site, submitting data, participating in an interactive area of the site,
or using the site or interacting with it in any other way. The term
"User" or "Users" therefore applies to anyone performing
any of the above actions.
- CHILDREN:
Children and their parents are our main audience. BFTV cares about
you. We respect the privacy and the freedom of choice of Children and
their parents and have taken steps to conform to the provisions of the
The Children’s Online Privacy Protection Act (“COPPA”). If you
are under the age of 13 (“a Child”), or a parent of a Child, please
see Section 8 below which contains the special provisions of our privacy
policy regarding Children and their parents.
- BFTV may amend this
Privacy Policy at any time, without giving any prior direct notice to
users. However, we will post notices of any changes on the site with
details of the date of the post. Posting of the amended Privacy Policy
will constitute notification of its Amendment. All amendments will come
into effect and bind users once posted on this site. Users are encouraged
to check this Privacy Policy frequently for amendments.
- The
Information We Collect
General
- BFTV collects certain
information submitted to us by Users or transferred to us during the
course of communication between the User and this site. Much of this
Information is non-personally identifiable information, but in some
cases we also collect personally identifiable information as detailed
in the following sections.
Non-Personally
Identifiable Information
- Use of this site
involves the transfer of certain information between your computer and
our servers, such as your computer's IP address and the type of browser
you are using. This Information is referred to as non-personally identifiable
information, because it does not directly identify you, although it
may identify the computer which you are using.
Personally
Identifiable Information
- Use of certain services
and features of the BFTV site requires the submission of personally
identifiable information such as your name, address, email, account
name or number, user name or password, an I.D., a credit card number
and other information. In some cases, you may also be asked or required
to enter such information as your age or gender or other information.
Submission of personally identifiable information is voluntary. If you
do not wish to submit personally identifiable information, you may choose
not to use these services and features. We limit the personally identifiable
information that we collect about Children as set out in Section 8.
- When posting or
uploading any data or content to open areas of the site, such as Baby
of the Week, Video of the Week, Myfirst U Courses or when participating
in competitions or sweepstakes, certain personally identifiable information,
such as your user name or first name may be published on the site. This
may apply to additional features of the site that we may add in the
future, such as communities and blogs. This information and any other
personally identifiable information which you choose to publish on any
part of this site will become accessible to other Users who may choose
to collect such information and to contact you. Any data or content
that you upload or post may be redistributed on the internet or in other
media. You should always exercise caution when responding to any contact
or request that you receive from someone you do not know, or who you
suspect may be posing as someone you know.
Automated
Collection of Information
- We use "cookies",
which are small files containing a string of characters that uniquely
identify your computer. Cookies are sent to your computer when you access
our site in order to help us improve the quality of our service by storing
information on user preferences and use of our site, such as the terms
you search for. Depending on the type of browser you use, you can set

- BFTV's servers automatically

and Disclosure of Information
- We may use and process
all information, including your personally identifiable information
to provide you with, improve and personalize services, features, content,

more fully in Section 8.
- Third Party Advertisers
and Ad Servers
- We may use third
parties, sometimes referred to as ad-servers to send or present advertisements
or promotions on our behalf or on behalf of our business partners or
affiliates. These third parties may also use cookies, web beacons or
other technologies to help send or present such advertisements and promotions,
and to conduct research about their effectiveness.
- We also allow third
parties to advertise on our site. We do not share personally identifiable
information with third party Advertisers, but these third parties may
use cookies, web beacons or other technologies in their advertisements
to gather information whenever an advertisement is delivered or shown
to a user or when a user clicks on an advertisement. An advertisement
may contain a link to the site of the advertiser. When you click on
an advertisement, you may be transferred to the site of the advertiser.
- The collection and
use of information by third party advertisers and ad-servers is governed
by the Privacy Policy of the advertisers and ad servers.
- Storage of Information

on secured servers and we shall use our best efforts and industry standard

information that you have previously provided to us.
- User Choices

stated above, others are set out below.
- If you do not wish
any information of any type, including non-personally identifiable information
to be collected about you, you should not use this site.
- If you do not wish
to submit personally identifiable information, you should not submit
any personally identifiable information. Please take into account that
in this case you will not be able to use certain features of this site,
although you will be able to continue to use other features.
- If you do not wish
your user name, real name, personal picture or other such information
to be published you should not submit data of this type.
- If you are concerned
about cookies, you should make use of the features on your Browser that
allow you to restrict or block cookies. In this case you will not be
able to use certain features of this site. If you are concerned about
other collection or tracking technologies that may be used on this site

such information by clicking on the link provided in all electronic
communications received by you and following the instructions. In
such case, we shall refrain from sending you advertising or promotional

right to continue to contact you regarding your account and important
information about this site.

Modifying Your Personally Identifiable Information

submitted by you (not including user name) by using the access feature

amend or delete all or some of your personally identifiable information
stored on our servers, by using the delete feature in the My Account
area on the site. However, we cannot guarantee that such deletion will
remove all such information from all areas of the servers.

if you chose to modify, or request us to delete any personally identifiable
or other information, we may retain copies of the information as originally
submitted in order to ensure payment for any goods and services and
as may be required by an order or subpoena issued by a judicial or administrative
authority or by a law enforcement agency, or as we may in good faith,
consider necessary under law, or upon a request or demand received by
us in connection with a legal complaint, claim, suit or procedure.
- Children’s
Privacy
- The following provisions
apply to “Children”, meaning anyone under the age of 13. These provisions
have preference over any other provisions in this Privacy Policy and
will always apply to Children. This is because they are designed to
comply with COPPA, which is a law that aims to protect the privacy of
children online.
- We hope and believe
that the BabyFirst website will be useful and entertaining for babies
and preschoolers, as well as for others, including their parents. However,
if you are a Child, you should use this site only if your parents or
your legal guardian (from now on we will now refer to both parents and
legal guardians as “parents”) agree to that and have read and approved
the Terms and Conditions, including this Privacy Policy. If your parents
have not read and approved the Terms and Conditions or this Privacy
Policy, please do not continue to use this site unless and until they
do so.
What
Personally Identifiable Information
do we collect about Children?
- Parts of the areas
of this site can be used without the need for submitting personally
identifiable information. We only collect personally identifiable information
about Children in those areas of the site that require that, such as
BabyU, video channels, Baby of the Week, courses and certain competitions
and sweepstakes. In these cases we collect some or all of the following:
the Child’s first name, his or her parent’s email address, his or
he parent’s user name and/or password. In certain cases, when we need
to send something by regular mail, or to personally speak to a Child’s
parent we may also need to collect his or her physical address and/or
telephone number.
- We will not collect
personally identifiable information about a Child unless the Child’s
parent has granted his or her consent to the provision of that information.
If you are a Child, please do not submit any personally identifiable
information about yourself, such as your name and email, address, age
or telephone number or other details. Instead ask your parents to do
that, if they agree.
- When personally
identifiable information about a Child is submitted to us, we will contact
the Child’s parent as soon as possible at the email address provided
and ask him or her to verify that they have agreed to the submission.
If the parent does not respond within two days, we will delete the personally
identifiable information submitted.
- Under the provisions
of COPPA we are not allowed to condition a Child’s participation in
a contest, sweepstake or other activity on the submission of more personally
identifiable information than is reasonably necessary for that.
How do we
use Personally Identifiable Information
about Children?
- In most cases we
will only use personally identifiable information about Children to
allow the Child to participate in activities and areas on this site.
We will use the email address of the Child’s parent in order to contact
him or her to verify that he or she has given his or her consent to
the Child’s submission of information. We may use the Child’s
name and his or her parent’s email address to inform his parent of
special offers and about new features on the site. We may use the address
or telephone number submitted by a Child in order to contact his parent
to inform him or her if the Child wins a prize in a contest or sweepstakes,
or to send the prize.
Sharing
of Personally Identifiable Information about Children.
- We may disclose
the personally identifiable information submitted about Children to
third parties who provide technical services or are involved with the
maintenance and operation of this site and its related features. In
such case we shall require them not to disclose or transfer the information
to any third party. Additionally, we may provide personally identifiable
information or non-personally identifiable information, or both to a
third party, as required by an order or subpoena issued by a judicial
or administrative authority or by a law enforcement agency, or as we
may in good faith, consider necessary under law, or upon a request or
demand received by us in connection with a legal complaint, claim, suit
or procedure.
- Other than that,
we will not disclose personally identifiable information submitted by
Children unless we receive the consent of the Child’s parent.
- We will not allow
the disclosure of personally identifiable information about a Child
on publically accessible areas of this site without the Child’s parent’s
consent. In these cases we will not rely on the general consent received
from the parent for the submission of the Child’s personally identifiable
information, but will ask for further consent which may be verified
in a more strict way, such as asking the parent to send us a signed
consent form by post or fax, have a trained operator speak to the parent
in person by telephone, or by asking the parent to submit a valid credit
card number.
How can
parents access, receive and amend details about their Child’s
information
- Parents may at
any time contact us to receive information about the kinds of information
we collect about Children and about the specific information collected
about the parent’s Child. This can be done by contacting us at:

- When you contact
us to ask for specific information about your Child’s information,
we will first verify that you are the Child’s parent. We may do this
in one of the following manners: asking you to send us a signed verification
form by post or fax, asking for photographic or documentary proof of
identity, through a trained operator who will speak to you in person
when you call the above dedicated telephone number, or by asking you
to submit a valid credit card number.
- You may also the
access personal information about your Child and amend or delete it
by using the function at My Account and entering your user name
and password
- Parents may, at
any time, revoke their consent given for the collection of personally
identifiable information about their Child, or for any further collection
of personally identifiable information, by contacting us as provided
above. We will follow the same procedures to verify that you are indeed
the Child’s parent. After receiving such request we shall delete the
Child’s personally identifiable information. This may result in the
Child being unable to continue to participate in certain activities
and areas of this site where that information is required, but he or
she will be able to continue to use the other areas of this site.
Changes
to this Policy:
- if we make changes
to the provisions of this policy regarding Children, we will post them
on the site. In addition we will send notification to parents of Child’s
whose email address has been provided to us. Therefore, if a parent
changes his or her email address please inform us of such.
- Links
- We may offer links
to other sites that we feel may be of interest to you. Please note that
by clicking on a link, you will be transferred to that other site and
any activity on it will no longer be governed by this Privacy Policy,
but by the privacy policy of that other site. We are not a party to
any third party privacy policy, do not endorse or recommend any third
party privacy policy and are not responsible for any such policy. You
should independently review any third party privacy policy and make
an independent determination whether it is acceptable to you or not.
